The USAID COMMERCIAL JUSTICE ACTIVITY is working on reforms that promote investment, economic growth, and job creation. The Activity collaborates with judicial and non-judicial institutions to improve commercial litigation, expand awareness of Alternative Dispute Resolution, and strengthen accountability in judgment enforcement while fostering an understanding of how these processes are critical to trust in the judicial system.
IMPROVE RESOLUTION OF COMMERCIAL DISPUTES IN COURT
- COMMERCIAL COURT REFORM With program support to the Ministry of Justice, the government has adopted a draft Law on Commercial Court that will establish a standalone court to effectively handle business and investor disputes. The draft law is pending in the Assembly;
- TRAININGS To strengthen the level of professionalism and responsiveness of the judiciary in commercial cases, #CommercialJustice Activity supports the Kosovo Justice Academy to develop a commercial law training curriculum for judges and court staff and pilot a next generation of trainers with 21st-century skills.
THE PROGRAM SUPPORTS IMPROVING GOVERNANCE, CAPACITY, AND PROFESSIONALISM OF THE PROFESSION OF PRIVATE ENFORCEMENT AGENTS
- Development of an automated enforcement management system that will streamline and unify how private enforcement agents handle cases and provide badly needed performance data to the Ministry of Justice
- Private Enforcement Agents are held accountable
- Technical assistance to develop processes and procedures and build strategic planning and communications of the chamber of Private Enforcement Agents;
- Professional Standards will secure professionalism in service delivery, ethical behavior, and consistent application of procedures and tariffs.
