Dushanbe, Tajikistan, February 3, 2023 – USAID, together with the Parliament of the Republic of Tajikistan, presented the new Civil Code to representatives of relevant state bodies and civil society organizations. USAID’s interest was generated by the Code’s provisions related to land governance.
The new Civil Code of the Republic of Tajikistan was approved on December 24, 2022 and will become effective on July 1, 2023. It not only will determine the main directions, priorities, and tasks in the sphere of civil legislation, it sets forth provisions to regulate property and personal non-property relations, as well as the procedure for exercising intellectual and other property rights, corporate relations, contractual and other obligations. Specifically with respect to land governance, the new Code sets forth the rights and obligations of dekhkan farms and simplifies land registration procedures.
During the event, the speakers presented these changes as well as others, including defining the various forms of agriculture businesses (dekhkan farms, cooperatives, Joint Stock and Limited Liability Companies) and allowing for the establishment of public and private user-rights to land plots. In the future, the new Civil Code will also make it possible to include all issues of regulation of land relations in the Land Code. The participants highly appreciated the relevance of the new Civil Code and its compliance with the modern requirements of land relations and registration of rights to immovable property.
USAID will continue supporting the Government of Tajikistan to improve land tenure security and promote inclusive agricultural policy reforms by building demand for and supply of land governance services and engaging public and private sector actors in the design, review, and implementation of policies.
The Feed the Future and Land Governance Activity in Tajikistan is the initiative of the United States Agency for International Development (USAID), in partnership with DAI Global in Tajikistan, Dushanbe, 48 Ayni Street Sozidanie Building, 2nd floor: Alg_info@dai.com
